Supreme Court checklist for defects in applications to set aside a statutory demand
The Supreme Court of Victoria uses a checklist to 'groom' applications to set aside statutory demands for any problems before the first return of the matter for directions. The checklist is attached below.
Review this list before service of a statutory demand, and again before attending the first return of the application (usually on "Wind-up Wednesdays") when directions orders are made.
Any defects within or relating to the application to set aside are usually picked up by the Court using this checklist. Practitioners should avail themselves of the opportunity to ensure there are no problems from the outset, or to fix any problems which have arisen, if possible.
Another indispensable tip: call the court the day prior to the first return and ask to see the file. The Court will allow you to review this checklist after the Court has completed it. That way you can rest assured everything is in order, or take steps to address any issues before the hearing.
